Before applying, firms should ensure that the licensed individual to be appointed agent in charge has the necessary licenses. Firms should also gather proof of incorporation, or foreign qualification for out-of-state firms, in anticipation of application requirements.

• the manner in which you transact Alaska risk resident insurance falls within the definition of Third-Party Administrator;
• you represent a domestic insurer or you are a resident who does not provide services to ERISA plans; or
• you represent a foreign insurer, your home state is not yet accredited by the National Association of Insurance Commissioners; or you are not licensed as a Third-Party Administrator in your home state.

Registration Exemptions:
A person who is an admitted insurer or an employee of an admitted insurer, who acts within the course and scope of that employment, and within the scope of the insurer's certificate of authority is not required to be registered under this section. A person who performs management services for an admitted insurer is not required to be registered as a Third-Party Administrator if the person's compensation is not based on the volume of premium written and the person
(1) is a wholly-owned subsidiary of the admitted insurer;
(2) wholly owns the admitted insurer;
(3) is a wholly-owned subsidiary of the insurance holding company that owns or controls the admitted insurer;
(4) is a United States manager of the United States branch of an alien admitted insurer; or
(5) is the manager of a group, association, pool, or organization of admitted insurers that does joint underwriting if it is subject to examination by the authorized insurance regulator in the state in which the person's principal place of business is located.



A credit union or a financial institution subject to supervision or examination by federal or state banking authorities, or a mortgage lender, that performs no functions other than advancing premiums to the insurer and collecting a debt from the insured is not required to be registered as a Third-Party Administrator.



A credit card issuing company that performs no functions, including adjustment or settlement of claims, other than advancing and collecting premiums from its credit cardholders who have authorized collection is not required to be registered as a ThirdParty Administrator.


 


A person, who only provides services to bona fide employee benefit plans that are established by an employer or an employee organization, or both, for which the insurance laws of this state are preempted under the Employee Retirement Income Security Act of 1974, is not required to be additionally registered as a Third-Party Administrator if the person certifies to the director on or before February 1 of each year his/her exempt status.

COMPLIANCE OFFICER INFORMATION
• Designated Compliance Officer is responsible for the actions of the firm and all representatives of the firm.
• Designated Compliance Officer must be qualified for all lines held by the registered firm.

Required Documents: 

  • All basic organizational documents of the Third-Party Administrator, including articles of incorporation, articles of association, articles of organization, partnership agreement, trade name certificate, trust agreement, shareholder agreement and other applicable documents and all endorsements to the required documents.
  • Bylaws, operating agreements, rules, regulations, and similar documents regulating the internal affairs of the administrator
  • The names, mailing addresses, physical addresses, official positions and professional qualifications of persons who are responsible for the conduct of affairs of the Third-Party Administrator, including the members of the board of directors, members of the limited liability company or partnership, board of trustees, executive committee or other governing board or committee, the principal officers in the case of a corporation or the partners or members in the case of a partnership or association, shareholders holding directly or indirectly 10 percent or more of the voting securities of the Third-Party Administrator and any other person who exercises control or influence over the affairs of the Third-Party Administrator.
  • Certified (audited) financial statements for the prior two years prepared by an independent certified public accountant that establishes that the applicant is solvent, that the applicant's system of accounting, internal control, and procedure is operating effectively to provide reasonable assurance that money is promptly accounted for and paid to the person entitled to the money. If the applicant submits a consolidated statement, a consolidating worksheet for the applicant must also be

  • A statement describing the business plan including information on staffing levels and activities proposed in this state and in other jurisdictions and provide details establishing the Third-Party Administrator's capability for providing a sufficient number of experienced and qualified personnel in the areas of claims handling, underwriting, and record keeping.
  • Identify the key personnel who supervise or have responsibility over personnel performing TPA functionsFor the Compliance Officer:

    • Provide personally-identifying information
    • Provide education information
    • List all certifications
    • Conduct and background questions
  • All documents necessary to verify statements contained in or in connection with the application.
  • A series of questions and requests for information from each insurer under contract with the TPA

Adjuster - A person or firm that is paid to adjust, investigate, and negotiate claim settlements. There are 3 categories of adjusters: company, independent, and public. Company adjusters work for insurance companies and investigate claims on behalf of the company. Independent adjusters investigate claims on a contractual basis for insurance companies. Public adjusters investigate claims on behalf of claimants, usually to determine the amount of money that can be claimed.

Agent in Charge - A licensed individual responsible for the supervision of all individuals within an insurance agency. The agent in charge must be licensed in the same lines as the agency.

Insurance Agent - Insurance agents act as intermediaries between the insurance company and policyholders. Agents can be either captive or independent. Captive agents represent a single insurance company, while independent agents represent multiple insurers.

Insurance Broker - Individuals who sell insurance policies while representing the interests of the buyer. Brokers are typically independent intermediaries without an insurance company affiliation.

Insurance Producer - May be used to refer to either individual insurance agents and brokers or insurance agencies and brokerages.

Managing General Agent - An agent or broker that is involved in underwriting and has other areas of authority normally handled by insurers. MGAs are typically involved in unusual lines of coverage or in geographically prohibitive areas.

Surplus Lines Insurer - An insurance carrier that takes on risks that a licensed carrier is unwilling to insure. Surplus lines insurers do not have access to state guaranty funds and are less tightly regulated by state governing bodies.

Third Party Administrator - An organization that manages group insurance policies and works with the employer and insurance carrier to process claims, handle loss control, and provide risk management and consulting services.

Title Agent - Title agents sell insurance that protects real estate owners against loss of ownership of a property due to a legal claim.

Viatical Settlement Provider - A company that purchases life insurance policies at a discount from individuals seeking immediately available funds.

Advocacy group of independent insurance brokers and agents.

Professional association that advocates for favorable regulatory conditions for insurance agents and financial advisors.
