Companies that provide employment services in Louisiana must apply for a license prior to doing business. Depending on the services offered, businesses may need to apply for more than one license type, and in some cases, an individual license will be required as well.

Companies acting as employment agencies in Louisiana must obtain the following licenses before offering employment services. Applications usually require proof of incorporation or a certificate of authority.

If the PEO or any person acting on its behalf is engaged in the business of soliciting, selling, or negotiating policies of insurance or providing insurance products as part of your PEO services, the applicant must provide the name, address and Louisiana license number of the licensed producer(s) through which insurance business will be conducted.

Required Attachments:
  • Physical addresses of all principal business establishments of the PEO inside and outside of Louisiana
  • The name, address and Louisiana license number of the license producer(s) through which insurance business will be conducted (if applicable)
  • The full legal name (no initials), social security number, date of birth, state of residence, position with the applicant and the percentage of ownership (if applicable) of the applicant of all natural persons responsible for the conduct of affairs of the applicant. This list should include all officers, all directors, all partners (in the case of a partnership), all trustees, all executive committee members and every natural person owning, directly or indirectly, 10 percent or more of the applicant and any other natural person who exercises control or influence over the affairs of the applicant.

Notes:
  • All responses must be consistent with all information filed with the State of Louisiana. Conflicting information will result in the rejection of the registration
  • Controlling persons is defined as:
    •  (a) An officer or director of a corporation, a shareholder holding ten percent or more of the voting  Stock of a corporation, a general partner of a partnership, or a manager of a limited liability Company
    • (b) An individual who possesses, directly or indirectly the power to direct or cause the direction of the Management or policies of a person or entity through the ownership of voting stock by written Contract. 
  • There are two methods of filing. With either method selected, you will be required to complete an Employer Application for LA Unemployment Account.
    • Filing Separately
      • Filing separately for each client, with each client having his own account number and
        experience rate. This method makes both PEO and client jointly and severally liable for taxes.
      • When filing each client separately on the Employer Application, fill in the Employer name with the LEGAL name of the company. Report the DBA name, if any.
      • For the mailing address, put the address of the PEO company.
      • A physical address must be provided for each client. If the employee is working from home, provide the city in Louisiana where he /she resides.
    • Filing Under the PEO’s Account Number
      • Requires posting a $100,000.00 surety bond.
      • This method releases the PEO client from joint and severability. There is no experience rating record transfer between the PEO and client.

  • Articles or Incorporation,  or other formation.  documents
  • The name, social security number, resident address, position and percent of ownership of all persons responsible for the conduct of affairs of the applicant. This list should include all officers, all directors, all partners (in the case of a partnership), all trustees, all executive committee members and all person(s) owning, directly or indirectly ten (10) percent or more of the applicant and any person who excesses control or influence over the affairs of the applicant.
  • A list of the PEO's clients, including the name, address, physical address and current or previous Unemployment Insurance (SUTA) account number for each.
Bond Amount:

Professional Employer Organizations (leasing) electing to file all clients under one employer
account number must obtain a surety bond in the amount of $100,000.

Employee Leasing Company - Enter into leasing contracts with other businesses that require labor. The leasing company loans its workers to the lessee while still providing specified responsibilities, such as workers compensation insurance, to the employees. This includes long term (6 months or more) temporary arrangements but often excludes temporary help arrangements. Unlike professional employer organizations, employee leasing companies are contracted when an employer needs to hire staff and does not want to handle human resources responsibilities.

Employment Agency - An entity that, for compensation, procures or attempts to procure employment for a person.

Professional Employer Organization - PEOs take on the human resources role for businesses and act as a co-employer in the sense that the client company's workers are administratively employees of the PEO but functionally these employees are controlled by the client company. Unlike employee leasing companies, PEOs are contracted when an employer already has staff and does not want to handle human resources responsibilities.

Staffing Agency - An entity that procures temporary or part-time employment for a person who then works under the supervision of a worksite employer.

Talent Agency - An entity that, for compensation, procures or attempts to procure employment or placement for an artist. (Certain art forms are excluded)
